Abstract
Despite bearing the appearance of a condition and its affinity with such figure, this study analyzes whether the so-called conditio iuris is a condition as such and its potential use by the parties as conditio facti. This covers hypotheses such as those bearing prenuptial agreements, donations or inheritance in favor of the unborn child, business concluded without power of attorney or judicial authorization, where the law subordinates its effectiveness or validity to a future and uncertain event, such as the entering into a marriage, the existence of a person or the ratification by the dominus. These hypotheses lead to academic discussions between those who defend a wide notion of the validity of legal conditions and those who support a restrictive vision thereof. These conditions are, in any case, excluded from party autonomy, which raises the question of their value within the legal transaction to which they constitute a factual element.
